Terms of Service

These Terms of Service ("Terms") govern your access to and use of the WildSEO platform, website, and related services (collectively, the "Service") operated by CryptoPerk, Inc. d/b/a WildSEO ("WildSEO," "we," "us," or "our").

By creating an account, accessing, or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you may not use or access the Service.

WildSEO provides analytics and insights into how brands appear across AI search engines and conversational models. The Service processes prompts, model responses, and related metadata to generate visibility, sentiment, and competitor analysis reports.

We may enhance or modify the Service periodically. If we make material changes that significantly reduce core functionality, we will provide advance notice.

You must be at least 18 years old and capable of entering into a binding agreement to use WildSEO.

When registering for an account, you agree to provide accurate information and maintain the confidentiality of your credentials. You are responsible for all activity that occurs under your account.

We may suspend or terminate access if you violate these Terms or if we reasonably believe your use presents a risk to the Service or others.

You may use the Service solely for lawful business purposes and in compliance with these Terms.

You agree not to:

• Attempt to copy, modify, or reverse engineer any part of the Service.
• Use bots, scripts, or automated systems to query, scrape, or overload the Service.
• Submit unlawful, infringing, or misleading content.
• Interfere with or disrupt the performance, security, or integrity of the Service.
• Rely solely on any analytics or AI outputs as factual without independent verification.

We reserve the right to suspend or terminate accounts engaged in prohibited activities or misuse.

WildSEO and its licensors own all rights, title, and interest in the Service, including its software, design, algorithms, and documentation.

You retain ownership of any data, content, prompts, or materials you upload to the Service ("Customer Data"). By using the Service, you grant WildSEO a limited, non-exclusive, worldwide license to process and analyze Customer Data solely to operate and improve the Service.

WildSEO may use anonymized and aggregated data for analytical or product improvement purposes, but will not disclose Customer Data in an identifiable form without your consent.

The Service analyzes and aggregates outputs from third-party AI and search providers. These outputs may be incomplete, biased, or inaccurate.

WildSEO makes no guarantee regarding the accuracy or completeness of such data. The insights and analytics provided are for informational purposes only. You are responsible for verifying and interpreting results before relying on them in business decisions.

Access to certain features of the Service requires a paid subscription. Pricing, available plans, and add-ons are described on our website.

All fees are billed in advance and are non-refundable except where required by law. You authorize WildSEO to charge your selected payment method automatically for renewals and additional usage-based fees (such as prompts, tokens, or organizations).

If a payment cannot be processed, WildSEO may suspend or terminate your access until the issue is resolved.

These Terms remain in effect while you maintain an account or use the Service.

You may cancel your subscription at any time through your account settings. WildSEO may suspend or terminate your account if you violate these Terms, fail to pay fees, or use the Service unlawfully.

Upon termination, your access will end, and Customer Data may be deleted after a retention period. You are responsible for exporting your data before termination.

WildSEO implements commercially reasonable administrative, technical, and physical safeguards to protect Customer Data.

We do not share or disclose Customer Data except as necessary to operate the Service, comply with applicable law, or with your explicit consent.

The Service may process information through trusted third-party AI or analytics providers. WildSEO selects such providers based on appropriate contractual and security standards.

The Service is provided "as is" and "as available."

WildSEO disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that the Service will be error-free, uninterrupted, or meet your performance expectations.

To the fullest extent permitted by law:

• WildSEO will not be liable for indirect, incidental, consequential, or special damages, including loss of profits, data, or goodwill.
• WildSEO's total aggregate liability for all claims arising under these Terms will not exceed the total amount you paid in the 12 months preceding the claim.

Certain jurisdictions do not allow some limitations; in such cases, liability is limited to the maximum extent permitted by law.

You agree to defend, indemnify, and hold harmless WildSEO, its affiliates, officers, and employees from any claim, liability, or expense arising from your misuse of the Service, violation of these Terms, or infringement of third-party rights.

Unless you opt out by emailing hello@wildseo.co, you grant WildSEO permission to include your organization's name and logo in customer listings or marketing materials.

WildSEO will never disclose confidential or performance data without prior written consent.

WildSEO may update these Terms periodically. Material changes will be communicated via email or in-app notice before they take effect.

Continued use of the Service after updated Terms become effective constitutes acceptance of the new Terms.

These Terms are governed by the laws of the State of Delaware, excluding its conflict of law rules.

Any disputes, claims, or proceedings arising out of or related to these Terms or the Service shall be brought exclusively in the state or federal courts located in San Mateo County, California, and each party irrevocably consents to the personal jurisdiction and venue of such courts.

You agree to resolve disputes individually and waive participation in class or collective actions.

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the complete agreement between you and WildSEO.
• Severability: If any provision is held invalid, the remaining provisions remain in full effect.
• No Waiver: Failure to enforce any right or provision is not a waiver.
• Assignment: You may not transfer your rights or obligations under these Terms without WildSEO's prior written consent.
